We manage your property as if it were our own (without moving in).

Our mission: smooth stays, happy guests, and a well-maintained home.

In short:

• One single plan: Peace of Mind — 25% of accommodation revenue (excluding cleaning, taxes, and extras).

• We work with Hostaway to centralize everything: calendar, messaging, check-in, monitoring, etc.

• Security deposit: credit card pre-authorization or Swikly (France & Mexico).

• In Mexico, an optional monthly maintenance plan is available (“maintenance only” or “maintenance + utility payments”).

And above all:

✅ We take care of guests (messages, check-in/out, providers, incidents)

✅ You keep visibility and control (reporting, approvals when required)

❌ No “freewheeling” operations: one pilot, one method, one process.

0. Entity Identification

Services are provided depending on the location of the property.

1. Definitions

• Owner: property owner or holder of a valid management mandate authorizing rental.

• Property: accommodation entrusted for management (France or Mexico).

• Guest: final occupant of the Property (direct booking or via platform).

• Platforms: Airbnb, Booking.com, Expedia, etc.

• PMS / Management Tool: Hostaway (calendars, messaging, payments by channel, automations).

• Services: short-term rental management services described herein.

2. Purpose and Scope

These Terms govern the relationship between Booking Guys (France or Riviera) and the Owner for:

• marketing and distribution of the Property,

• operational stay management,

• provider coordination,

• guest assistance,

• and, more broadly, seasonal rental management under the subscribed plan.

3. Onboarding Conditions

Before listing / operating the Property, the Owner must provide:

• valid ID,

• proof of ownership or management mandate,

• country-specific documents (see Annexes A/B),

• technical property details (access, inventory, house rules, equipment).

Booking Guys may refuse a Property in case of non-compliance, legal/technical risk, operational impossibility, or reputational risk.

4. Single Plan

Peace of Mind Plan

4.1 Included Services

• Creation/optimization of listings and distribution (direct site + platforms per strategy)

• Hostaway setup (calendar, messaging, rules, base pricing)

• Guest inquiry and message management (multilingual)

• Check-in / check-out coordination (self or assisted depending on building)

• Cleaning, linen, and consumables coordination (depending on country/local setup)

• Maintenance reporting and follow-up

• Guest assistance during the stay (per internal procedures)

• Basic reporting and performance monitoring

4.2 Management Fee

Single commission: 25% of accommodation revenue

(excluding tourist tax, re-invoiced cleaning fees, security deposits, and ancillary/extras).

The commission is calculated on net nightly revenue only, not on ancillary costs.

A minimum commission per booking may apply if necessary

(€40 in France / MXN $850 in Mexico).

5. Monthly Maintenance (Mexico)

For Properties located in Mexico, Booking Guys Riviera may offer a monthly maintenance plan (preventive & light corrective), essential to preserve the Property’s value.

Two possible options:

1. Maintenance only

2. Maintenance + utility bill payments (CFE, internet, water, HOA/building fees) on behalf of the Owner

Exact pricing and inclusions are detailed in the Property’s contract or operational addendum (Annex B).

6. Pricing, Payments & Owner Payouts

6.1 Payment Channels

• Platform bookings: payments managed by the platform (Airbnb, Booking, etc.), then released per their rules.

• Direct bookings (website/booking engine): payments processed via payment providers connected to the PMS/website.

6.2 Owner Payouts

Owner payouts depend on:

• platform and bank processing delays,

• deduction of Booking Guys’ commission,

• deduction of authorized and re-invoiced expenses (providers, consumables, interventions).

7. Security Deposit

Booking Guys may manage security deposits via:

• credit card pre-authorization (France & Mexico),

• Swikly (France & Mexico),

• depending on Property settings and/or booking channel.

In case of damage, the Owner must provide within a reasonable timeframe: photos, estimates/invoices, description, dates, and evidence.

Booking Guys assists with the process but does not guarantee outcomes (bank/platform/insurer decisions).

8. Cancellation Policy

• Platform bookings: the platform’s cancellation rules apply and prevail in case of conflict.

• Direct bookings: cancellation rules defined on the website or Property contract apply.

9. Owner Obligations

The Owner agrees to:

• provide a compliant, clean, safe, and properly equipped Property,

• maintain essential systems (electricity, water, A/C or heating, internet if advertised),

• allow access to providers and required interventions,

• comply with local regulations (see Annexes A/B),

• avoid direct guest contact outside the defined framework if it disrupts operations,

• inform Booking Guys of any HOA or internal building constraints.

10. Communication Hierarchy (Important)

To avoid inconsistencies:

• Owners do not communicate directly with guests (unless expressly agreed in writing).

• All guest communication goes through Booking Guys / Hostaway.

11. Personal Data

Each party agrees to comply with applicable data protection rules (GDPR for France/EU, local obligations in Mexico).

Booking Guys processes data strictly necessary for booking, stays, support, and compliance.

12. Liability

Booking Guys is bound by an obligation of means only (no guaranteed results: occupancy, revenue, reviews, etc.).

Booking Guys is not responsible for:

• platform decisions (cancellations, refunds, penalties),

• network outages or third-party provider failures,

• guest-caused damage (unless proven fault by Booking Guys),

• uncommunicated HOA or administrative constraints.

13. Suspension / Termination

Booking Guys may suspend listing or operations in case of non-compliance, legal risk, safety issues, serious disputes, abusive behavior, non-payment, or reputational harm.

The Owner may terminate per the Property’s contract/addendum: standard notice 30 days, with management of already confirmed bookings.

14. Intellectual Property

Content produced by Booking Guys (texts, photos, visuals) remains usable for Property operations.

Any external reuse beyond the agreed scope requires written authorization.

15. Governing Law & Jurisdiction

Applicable law depends on the contracting entity:

• France properties / Booking Guys France: French law, courts of Nice.

• Mexico properties / Booking Guys Riviera: Mexican law, courts of Playa del Carmen, Quintana Roo

(subject to adjustment per legal counsel: Cancún or Solidaridad).

ANNEX A — France Specifics (Nice / French Riviera)

This annex applies to properties located in France and managed by Booking Guys France.

A1. Local Regulations & Declaration Obligations

The Owner agrees to comply (depending on their situation) with:

• declaration and/or registration requirements with the local municipality when applicable,

• regulations related to change of use and/or mixed-use status of the property, where applicable,

• obligations related to tourist tax (collection and/or reporting depending on the booking channel),

• and, more generally, all local regulations applicable to furnished tourist accommodations.

Booking Guys may provide operational assistance; however, legal compliance (authorizations / legal status of the property) remains the sole responsibility of the Owner.

A2. Condominium / HOA Rules

The Owner certifies that:

• the condominium by-laws (RCP) do not prohibit the operation of furnished tourist rentals,

• and/or that the property benefits from the required authorizations.

A3. Security Deposit (France)

The security deposit may be managed through:

• credit card pre-authorization, and/or

• Swikly (depending on configuration and use case).

Conditions and timelines: photos, evidence, estimates and/or invoices in the event of a partial or full retention.

A4. Personal Data (GDPR)

The Owner agrees to:

• use guest personal data solely for purposes related to the stay,

• not share such data with unnecessary third parties,

• securely delete or archive data when retention is required (accounting / disputes).

ANNEX B — Mexico Specifics (Riviera Maya)

This annex applies to properties located in Mexico and managed by Booking Guys Riviera.

B1. Operational Specificities (Buildings, Receptions, Access)

The Owner acknowledges that:

• many buildings impose specific procedures (reception desks, identity checks, wristbands, badges, pool/gym rules),

• Booking Guys applies these procedures to secure access and prevent incidents,

• any specific constraints must be communicated in advance (house rules, schedules, access conditions, parking).

B2. Monthly Maintenance Plan (Optional but Recommended)

Purpose: to prevent accelerated wear and tear (humidity, air conditioning, plumbing, locks, filters, seals, etc.) and avoid major repairs.

Two available options:

1. Maintenance only

2. Maintenance + utility bill payments (in the name of and/or on behalf of the Owner)

B2.1 Typical Scope (To Be Adapted Per Property)

Typically includes:

• preventive visits and inspections (frequency defined in the contract),

• minor interventions (locks, seals, adjustments, screws, accessible filters, minor leaks),

• coordination of service providers for heavier interventions (plumber, A/C technician, electrician),

• monitoring and reporting (before/after when relevant).

Typically excludes (unless expressly agreed):

• major replacements (out-of-service A/C units, water heaters, large appliances),

• major works, renovations, structural damages,

• high-cost parts (billed at actual cost after prior approval).

✅ Recommended standard clause:

“Any expense exceeding X MXN requires prior approval from the Owner.”

(The exact amount to be defined contractually.)

B3. Utility Bill Payments (Optional)

If activated, Booking Guys Riviera may manage on behalf of the Owner:

• electricity (CFE), water, internet, HOA/building maintenance fees, etc.

Recommended operating terms (clear and dispute-proof):

• the Owner maintains a prepaid balance or agrees to monthly re-invoicing,

• each payment is supported by documentation (receipt / screenshot / invoice),

• any abnormal bill or significant increase triggers an alert and requires approval.

B4. Security Deposit (Mexico)

The security deposit may be managed via:

• credit card pre-authorization,

• Swikly (if selected),

• or other solutions depending on the booking channel (platform).

B5. Taxation & Local Compliance

The Owner remains responsible for all tax and administrative obligations related to property ownership and/or rental activity in Mexico.

Booking Guys may provide coordination assistance (documents, evidence, reporting) without replacing specialized tax or legal advice.
